General Terms and Conditions of Sale

These general terms and conditions of sale apply to all service offers from French Tech Factory related to orders placed with French Tech Factory by a client (hereinafter referred to as “the Client”). French Tech Factory reserves the right to update the GTC at any time.

The GTC are made available to the Client on the website of French Tech Factory. Any order placed with French Tech Factory implies unreserved acceptance of these GTC. The Client acknowledges having read and accepted the GTC before placing an order.

Any contrary condition, and in particular any general or specific condition put forward by the Client, cannot prevail over these GTC, unless formally and in writing accepted by the Company, regardless of when such condition may have been brought to its attention.

French Tech Factory offers training courses delivered exclusively by a qualified trainer, either in-person or remotely via real-time video conference.

French Tech Factory offers training activities falling within the scope of Article L6313-1 of the French Labor Code: Professional training actions designed to enable learners to develop or update their skills, know-how, and qualifications.

French Tech Factory training courses take place in-person in equipped rooms or remotely, live via video conference (Zoom, Google Meet, etc.).

In all cases, the training is delivered by a trainer in constant interaction with the learners.

We do not offer self-paced training via e-learning platforms. Each session is supervised by an instructor who facilitates, evaluates, and supports participants throughout their journey.

Our training courses are aimed at:

– Employees, as part of skills development plans or CPF (Personal Training Account).

– Job seekers.

– Freelancers, entrepreneurs, or liberal professions.

– Anyone wishing to develop their professional skills.

Each service includes:

– A preliminary interview or needs analysis.

– Provision of a detailed training program, including learning objectives, modalities, duration, prerequisites, and evaluation methods.

– A training contract or agreement.

– Training materials provided during the session.

– A certificate of completion mentioning the skills acquired.

– In-person training: at our premises or the client’s (under certain conditions).

– Remote training: via secure video conferencing tools.

– Sessions organized in-company (for a group within the same structure) or inter-company.

Our training organization supports you at every step, whether you are an individual, a company, or a freelancer, and whether your funding comes from an OPCO (skills operator) or the CPF (Personal Training Account).

Steps for ordering training.

The beneficiary (or company) contacts our team to:

– Express their training needs.

– Obtain detailed programs, prerequisites, objectives, and prices.

– Schedule an interview if necessary.

We will send you:

– A quote or a training agreement depending on your profile.

– The complete training program.

– Eligibility and funding arrangements adapted to your situation (CPF, OPCO, Pôle Emploi, self-funding, etc.).

Depending on the funding method:

For an OPCO: The company or freelancer submits a funding request via their OPCO’s extranet (Akto, Afdas, Atlas, etc.) with our quote/agreement and the attached program.

For CPF: The beneficiary reserves their session via MonCompteFormation.gouv.fr and submits their training request. Our organization validates the request within 48 hours.

Once funding is validated:

– A training agreement or contract is signed by both parties.

– An invitation is sent to the trainee.

– A connection link (for remote training) or the training location details (for in-person training) are provided.

Payment terms vary depending on the type of funding used for the training. In all cases, a training agreement or contract is established before the start of the activity, specifying the cost, payment terms, and cancellation conditions.

Before training: A funding request is submitted by the company (or freelancer) to their OPCO, accompanied by our quote, program, and training agreement.

After OPCO approval:

– The training organization invoices the OPCO directly at the end of the training.

– No payment is requested from the beneficiary if the coverage is full.

– In case of partial coverage, the remaining balance is invoiced to the company.

Usual payment period for OPCOs: between 30 and 60 days after receipt of the invoice and supporting documents (attendance sheet, certificate, assessment, etc.).

Payment is entirely managed via the platform MonCompteFormation.gouv.fr (via the Caisse des Dépôts).

Process:

– The beneficiary reserves the training session on the platform.

– Our organization validates the request.

– Payment is made directly by the Caisse des Dépôts, after the effective completion of the training, and upon submission of supporting documents.

No upfront costs for the trainee, except for any remaining balance if they do not have enough CPF credits. This remaining balance can be paid by credit card at the time of registration on the platform.

If the beneficiary or company funds the training directly (without an intermediary):

– A deposit (generally 30%) may be requested upon signing the contract.

– The balance is due before the start of the training, unless otherwise specifically agreed.

– Installment payment options may be offered on a case-by-case basis.

French Tech Factory makes every effort to ensure the quality and proper conduct of training sessions. However, certain situations may justify a cancellation or postponement. Here are the applicable terms depending on the case.

Training funded directly (direct payment).

Cancellation 15+ business days before training: Full refund of any amount paid, including the deposit.

Cancellation between 15 and 7 business days before training: The deposit remains acquired by the organization as compensation. The balance is not due.

Cancellations within 7 business days: The full amount is due, except in justified cases of force majeure (hospitalization, death, etc.).

Postponement at the client’s request: Possible free of charge up to 7 business days before the start. After this period, postponement fees may apply (up to 20% of the initial cost).

Training funded by an OPCO or CPF:

In case of late cancellation or no-show without justification:

– The OPCO or Caisse des Dépôts may refuse coverage.

– The cost of the training then becomes fully due by the client (individual or company).

In case of duly justified force majeure, the application can be cancelled free of charge.

In case of insufficient participants or major unforeseen circumstances (trainer unavailability, technical issue…), we reserve the right to cancel or postpone the session.

In this case:

– The client is notified as soon as possible.

– A new date is proposed.

– If no solution is suitable, any deposit or payment already received is fully refunded.

The client undertakes to provide all information and documents necessary for the proper execution of the service. They also undertake to be available for appointments agreed upon with French Tech Factory.

French Tech Factory undertakes to implement all necessary means to provide the service in accordance with the client’s expectations. In case of inability to provide the service, the Organization undertakes to inform the client as soon as possible and to propose an alternative solution or a refund.

French Tech Factory cannot be held responsible for indirect damages resulting from the execution of the service. The Organization’s liability is limited to the amount of the service.

All documents and materials provided by French Tech Factory within the scope of the service remain the exclusive property of the Organization. Any reproduction or distribution without written authorization is prohibited.

The parties undertake to keep confidential all information exchanged within the scope of the service. This obligation remains even after the completion of the service.

In accordance with current European (GDPR) and French regulations, French Tech Factory, in its capacity as data controller, undertakes to process its Clients’ personal data with the utmost care.

French Tech Factory respects a set of duties and grants its Clients a set of rights relating to their personal data.

The commitments made by French Tech Factory are listed on the website page Legal Notice GDPR, of which it constitutes the extension and complement, and is accessible on our website at french-techfactory.fr.

In case of dispute, the parties will endeavor to find an amicable solution. Failing this, the dispute will be submitted to the competent courts of the Organization’s registered office.

These General Terms and Conditions of Sale are subject to French law. Any dispute relating to their interpretation or execution falls under the jurisdiction of the competent courts of the Organization’s registered office.
